1. General Provisions

These Terms of Service ("Terms") govern the use of the website alektusrealty.com ("Website"), operated by Trading and Services Company in Real Estate AJTEMIS INVEST DOOEL SKOPJE ("Alektus Realty", "we", "us", "our"), with its registered office at Blvd. Ilinden No. 93/7, Ground Floor, 1000 Skopje, Republic of North Macedonia.

By accessing, browsing, or otherwise using this Website, you ("User", "you") acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of the Website immediately.

2. Nature of the Service

Alektus Realty is a licensed real estate agency providing brokerage, intermediation, advisory, and related services in connection with the sale, purchase, rental, and management of real estate properties and other jurisdictions where we may operate from time to time.

The Website serves as an informational and marketing platform. The Website itself does not constitute a binding offer to sell, lease, or transact in any property. All transactions are subject to separate written agreements executed between the relevant parties.

3. Intellectual Property

All content published on this Website — including but not limited to text, photographs, videos, floor plans, renderings, graphics, logos, trademarks, design elements, layout, structure, source code, databases, and software — is the exclusive property of Alektus Realty or its licensors and is protected under the Law on Copyright and Related Rights of the Republic of North Macedonia, EU intellectual property law, and applicable international treaties.

Any reproduction, copying, distribution, modification, public display, transmission, or commercial use of any content from this Website, in whole or in part, by any means and in any form, without the prior express written consent of Alektus Realty, is strictly prohibited and may result in civil and criminal liability.

Photographs of properties may also be subject to rights held by property owners, developers, or third-party photographers. Users may not download, repost, or otherwise use such images outside the context of the Website.

4. Acceptable Use

You agree to use the Website lawfully and in good faith. You specifically agree not to:

1. use the Website in any manner that could damage, disable, overburden, or impair its functionality, security, or availability;
2. attempt to gain unauthorized access to any part of the Website, its servers, databases, or related systems;
3. use any automated means (including bots, scrapers, crawlers, or data-harvesting tools) to extract, collect, or copy content, property listings, contact information, or any other data from the Website without our prior written consent;
4. reproduce, republish, or redistribute property listings, photographs, descriptions, or any other content on third-party websites, social media, marketplaces, or print media without prior written authorization;
5. submit false, misleading, fraudulent, or unlawful information through any contact form, inquiry, or other communication channel on the Website;
6. impersonate any natural or legal person or misrepresent your affiliation with any person or entity;
7. use the Website to transmit unsolicited commercial communications, spam, viruses, malware, or any other harmful code;
8. use any information obtained through the Website to compete with Alektus Realty, to solicit our clients, or to circumvent our brokerage services (see Section 5).

5. Anti-Circumvention and Broker Protection

Property information, owner contacts, developer contacts, and transaction details disclosed through the Website, by our agents, or in connection with any inquiry, viewing, or negotiation are confidential and shared exclusively for the purpose of facilitating a transaction through Alektus Realty.

Users expressly agree not to, directly or indirectly, through any third party, affiliate, spouse, relative, business partner, or legal entity:

1. contact any property owner, seller, developer, landlord, or other counterparty introduced by Alektus Realty for the purpose of concluding a transaction outside our agency;
2. bypass, circumvent, or attempt to circumvent Alektus Realty in any transaction involving a property, person, or opportunity first introduced to the User through the Website or our services;
3. disclose to any third party the identity, location, or contact details of property owners or properties introduced by us.

This obligation shall remain in effect for a period of twenty-four (24) months following the User's last interaction with Alektus Realty or the Website. Any breach of this clause entitles Alektus Realty to claim the full brokerage commission that would have been due (calculated as the higher of 3% of the transaction value or the commission stipulated in our standard tariff), plus any additional damages, legal costs, and interest. Separate viewing and cooperation agreements signed with clients may contain additional or supplementary terms, which shall prevail in the event of a conflict.

6. Property Listings and Information Accuracy

All property listings, descriptions, photographs, floor plans, prices, surface areas, yields, ROI projections, energy performance ratings, Golden Visa eligibility statements, payment terms, and other information published on the Website are provided for informational purposes only and on an "as is" basis.

Such information is typically sourced from third parties — including property owners, developers, sellers, public registries, and external consultants — and although we make reasonable efforts to verify its accuracy, Alektus Realty does not warrant, guarantee, or represent that any such information is complete, current, accurate, free of errors, or up to date.

Specifically, and without limitation:

1. Prices are indicative and may change without notice; final prices are determined by the property owner/seller and are confirmed only in a binding written contract;
2. Availability is subject to prior sale, lease, or withdrawal at any time without notice;
3. Surface areas, dimensions, and floor plans are approximate and must be independently verified;
4. Yield, ROI, and rental projections are estimates only, based on market assumptions, and do not constitute a guarantee of future financial performance;
5. Golden Visa, residency, tax, or other legal eligibility statements reflect general information available at the time of publication and do not constitute legal or tax advice; eligibility is determined exclusively by the competent authorities of the relevant jurisdiction;
6. Energy Performance Certificates are issued by certified independent engineers and Alektus Realty is not responsible for their content;
7. Translations between Macedonian, English, and other languages are provided for convenience; in case of discrepancy, the version in the language of the binding contract shall prevail.

Users are strongly advised to conduct independent due diligence — including legal, technical, fiscal, and physical inspection — before making any decision to purchase, lease, or invest in any property. Alektus Realty strongly recommends engaging an independent lawyer and, where applicable, a tax advisor.

7. Contact Forms and Inquiries

By submitting a message, inquiry, or request through any contact form, email address, or communication channel on the Website, you consent to the processing of your personal data for the purpose of responding to your inquiry and providing the requested services. You represent and warrant that any information you submit is true, accurate, and complete, and that you have the legal right to provide such information.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Website and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability.

Alektus Realty, its directors, employees, agents, partners, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages — including but not limited to loss of profit, loss of opportunity, loss of data, loss of goodwill, business interruption, or financial losses — arising out of or in connection with:

1. the use of, or inability to use, the Website;
2. any errors, inaccuracies, or omissions in any content, including property listings;
3. any decision made or action taken in reliance on information obtained from the Website;
4. any unauthorized access to or alteration of your transmissions or data;
5. any interruptions, delays, or technical malfunctions of the Website;
6. the conduct of any third party (including property owners, developers, buyers, sellers, lawyers, notaries, banks, or public authorities);
7. any external links or third-party services accessed through the Website.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under mandatory provisions of applicable law (including, where applicable, liability for gross negligence, wilful misconduct, or harm to consumers under EU consumer protection law).

Where liability cannot lawfully be excluded, it shall be limited to the minimum amount permitted by law.

9. External Links and Third-Party Services

The Website may contain links to third-party websites, services, platforms, or resources (including social media, mapping services, mortgage calculators, payment processors, and government portals). Such links are provided solely for convenience.

Alektus Realty has no control over, and assumes no responsibility for, the content, privacy policies, security, or practices of any third-party websites or services. The inclusion of any link does not imply endorsement. Access to and use of third-party websites is at your own risk and subject to the terms and policies of those third parties.

10. Force Majeure

Alektus Realty shall not be liable for any failure or delay in performance arising from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, war, acts of terrorism, civil unrest, governmental measures, sanctions, strikes, failures of telecommunications or internet infrastructure, cyber-attacks, or other events of force majeure.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of North Macedonia, without regard to its conflict-of-laws principles. Mandatory consumer-protection provisions of the country of habitual residence of a User who qualifies as a consumer under applicable EU law shall continue to apply where required.

Any dispute, controversy, or claim arising out of or in connection with these Terms, including their formation, validity, breach, or termination, shall be subject to the exclusive jurisdiction of the competent court in Skopje, Republic of North Macedonia, save where mandatory law dictates otherwise.

12. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent court, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original economic and legal intent of the parties.

13. Changes to Terms

Alektus Realty reserves the right to amend, modify, or update these Terms at any time and at its sole discretion. Any changes take effect upon publication on this page, and the "Last updated" date will be revised accordingly. Continued use of the Website following the publication of revised Terms constitutes your acceptance of those changes. We recommend reviewing these Terms periodically.
